Planning Board Meeting Minutes

Van Wyck Hall, 1095 Main Street, Fishkill, NY 12524

 

           Administrative:

        

          Chairman Hans Klingzahn opens the meeting at 7:00 pm.

 

Roll call: Present: Hans Klingzahn, Cris Phillips, Theresa Cuchelo and Reylene VanGeldern. Absent: Stephen Brown. Also present: Tom VanTine, Village Building Inspector and Code Enforcement Officer, Larry Paggi , Village Engineer. Victoria Polidoro, Planning Board Attorney and Don Van Nostrand, Board Secretary.

            

Chairman Klingzahn entertains a motion to approve the minutes for the meeting held on February 15, 2018. Cris Phillips, so moved. Motion seconded by Theresa Cuchelo. Discussion none, all in favor, Aye. Motion carried.

            Attorney John Comatos appeared on behalf of DaVita Dialysis and said they were still waiting

            for the letter that was written to Mr. VanTine on January 18th by the attorney for the

            Fishkill Center Associates to be retracted. We do not have an estimate when the letter will be

            retracted so we ask that the public hearing be adjourned indefinitely.

 

            Chairman Klingzahn asked the public if there were any comments at this time. No comments

            were made by the public and the Chairman asked for a motion to adjourn the public hearing

            indefinitely. Village Attorney Victoria Polidoro added that the applicant would have to come to

            another meeting and the board would reschedule the public hearing for another date and that

            it would have to be published in the paper again. Cris Phillips, so moved. Motion seconded by

           Theresa Cuchelo. Discussion none, all in favor, Aye. Motion carried.       

 

 Review:

            Grace Ruseskas authorized representative for CVS Pharmacy informed the board that the           

            Pharmacy was applying to change three signs on the building.

 

            Sign labeled 2A facing west was reviewed and a motion was made by Cris Phillips to approve

            the sign. Motion seconded by Reylene VanGeldern. Discussion none, all in favor, Aye. Motion

            carried.

 

            Sign labeled 2B facing north was reviewed and a motion was made by Cris Phillips to approve

            the sign. Motion seconded by Reylene VanGeldern. Discussion none, all in favor. Aye. Motion

            carried.

 

            Sign labeled 2C drive through sign was reviewed and a motion was made by Reylene VanGeldern

            to approve the sign. Motion seconded by Theresa Cuchelo. Discussion none, all in favor. Aye.

            Motion carried.

 

            2. Riverside Bank                    - 701 Route 9                                 - Sign Permit Application

             Grace Rusekas authorized representative for Riverside Bank (formally Orange County Bank

             And Trust) informed the board that the bank was applying to change two signs on the building.

             The existing sign on the building for Orange Bank and Trust is 27.3 square feet and we are

              requesting 27 square feet for Riverside.

 

             Code Enforcement Officer Tom VanTine reported that the new sign complies with the code.

 

             Chairman Klingzahn entertains a motion.

 

             Theresa Cuchelo moves to accept the sign for the south side of the building as per the

             application. Motion seconded by Reylene VanGeldern. Dscussion none, all in favor. Aye.

             Motion carried.

 

             Chairman Klingzahn entertains a motion on the sign for the east side of the building.

 

             Theresa Cuchelo moves to accept the sign as per the application. Motion seconded by Reylene

             VanGeldern. Discussion none, all in favor. Aye. Motion carried.

 

             Cris Phillips raised a question on the signage on the ATM and it was determined that a

             sign permit would also be required for that sign. Grace Rusekas said that she would submit

             a application for that signage.

        Attorney Jennifer VanTuyl representing the Ready Coffee project and introduced the applicant’s

        project team and the presenters at tonight’s meeting.

 

        Jamie Logiudice, Insite Engineering presented the site plan and pointed out updates to the

        plans (on file) based on the comments made by the consultants and board at the last meeting.

 

        Norm DiChiara, Architect presented plans on changes made to the outside of the building based

        on comments made by the board at the last meeting. (drawing on file).

 

        Larry Paggi, Village Engineer covered his comment letter (on file) and pointed out that the

        dumpster enclosure is being addressed. Also, he forwarded his comments to the traffic consultants

        on the site traffic flow and additional information is required on the drywells and grease traps.               

 

        Chairman Klingzahn read Sarah Brown’s comment letter (on file). He reported that a traffic study

        has just been completed and a copy was just delivered to the applicants.

 

        Jennifer VanTuyl thanked the board for their comments and said they would review the comment

        letter provided by FP Clarke Associates on the traffic study and the comments made on the site

        parking situation.
